Kraken’s Payward to Launch CFTC-Regulated Perpetuals on Hyperliquid

Payward, Kraken's parent, plans to deploy CFTC-regulated perpetual futures on Hyperliquid's HIP-3* permissioned market, with Bitnomial operating the market and NinjaTrader Clearing handling client accounts. The move could set a precedent for regulated DeFi derivatives in the U.S.

Kraken’s Payward to Launch CFTC-Regulated Perpetuals on Hyperliquid

Payward, the parent company of crypto exchange Kraken, plans to deploy a perpetual futures market for U.S. users on Hyperliquid, the decentralized derivatives platform announced. The move would make Payward the first institution to list CFTC-regulated trading products on a HIP-3* market, a new Hyperliquid framework for permissioned deployments. The plan is subject to regulatory approval.

Under the proposal, Bitnomial — Payward’s CFTC-regulated exchange and clearinghouse — will create, operate, and manage the market, handling contract clearing and settlement. NinjaTrader Clearing, a registered futures commission merchant, will manage client accounts. Hyperliquid said HIP-3* uses an on-chain allowlist mechanism to support permissioned market deployments. An initial version is live on testnet, and specifications may be adjusted based on feedback. The feature is an optional extension of HIP-3 and does not affect existing markets.

Industry Analysis and Implications

The arrangement represents a significant step in the convergence of decentralized infrastructure and regulated U.S. derivatives markets. By leveraging Hyperliquid’s on-chain order book and settlement layer while wrapping it in CFTC-compliant entities, Payward aims to bridge the gap between DeFi transparency and traditional regulatory oversight.

For Hyperliquid, the partnership validates its technology for institutional-grade, permissioned use cases. The HIP-3* allowlist mechanism allows market operators to control participation, addressing compliance concerns while preserving the efficiency of on-chain settlement. This could attract other regulated entities seeking similar deployments.

For the broader crypto industry, the move signals that U.S. regulators may be opening the door to compliant DeFi derivatives. If approved, it could set a precedent for how decentralized protocols interact with regulated intermediaries, potentially accelerating institutional adoption of on-chain perpetuals.

Forward-Looking Perspective

Success hinges on regulatory approval and operational execution. If Payward and Hyperliquid can demonstrate that on-chain perpetuals can meet CFTC standards for market integrity, surveillance, and investor protection, other exchanges may follow. However, challenges remain, including how on-chain data is shared with regulators and how disputes are resolved. The testnet launch is a promising start, but the real test will be in production with U.S. clients.
