CLARITY Act Odds Jump Above 30% as Bernstein Flags Short Squeeze Risk

Bernstein says prediction-market odds for the CLARITY Act have rebounded above 30% after Senate Republicans conceded on ethics language and added a bank-deposit circuit breaker. The firm warns the market's consensus 'fail' bet may reverse, with a procedural vote Tuesday and a Fed decision Wednesday.

CLARITY Act Odds Rebound as Senate Republicans Bend on Ethics Clause

Prediction-market implied odds for the Digital Asset Market Clarity Act (CLARITY) passing have climbed back above 30%, 2026. The bill would establish a federal regulatory framework for U.S. crypto markets, drawing the line between SEC and CFTC jurisdiction, defining exchange compliance obligations, and setting rules for stablecoin yield.

The shift follows a new Senate Republican draft that makes substantive concessions on Trump-related ethics provisions and adds a so-called “new circuit breaker” clause aimed at concerns over community bank deposit outflows. A procedural vote is scheduled for Tuesday, with the Federal Reserve’s rate decision arriving Wednesday.

Why the Market May Be Mispositioned

Bernstein argues that the market had broadly assumed CLARITY would fail — a consensus bet that now looks vulnerable to reversal. The firm characterizes the ethics concessions as close to the maximum Democrats could realistically extract, and notes that “no CLARITY is the worst outcome” not only for the crypto industry but also for banking lobbyists who have pushed for clearer rules of the road.

The setup matters because positioning in crypto-linked equities has leaned defensive. If the procedural vote advances the bill, forced short covering could amplify moves in names most sensitive to U.S. regulatory clarity.

Stablecoin Yield and Bank Deposit Fears

The circuit-breaker language is the most consequential new element. Community banks have warned that yield-bearing stablecoins could drain deposits, and the clause appears designed to give regulators a brake if outflows accelerate. For stablecoin issuers, the practical question is whether yield can be offered directly or only through intermediaries — a distinction that determines revenue models.

Bernstein reiterated outperform ratings and price targets of $140 for Circle, $330 for Coinbase, and $160 for Robinhood. Each target assumes a U.S. framework that legitimizes onshore stablecoin issuance and exchange operations.

Forward Look

The next 72 hours are binary. A successful procedural vote keeps the bill alive and could trigger a sharp repricing across exchanges, stablecoin issuers, and brokerage platforms. A failure resets the clock and validates the bear case that U.S. crypto regulation remains stuck in limbo. Traders should watch the Tuesday vote and Wednesday Fed decision as a paired event — rate cuts could soften the blow of a failed vote, while a hawkish Fed plus legislative failure would be the worst combination for risk assets.
