Trump-Linked Crypto Firms Build Legal Firewall Ahead of Midterms

Trump-affiliated crypto companies are hiring lawyers and lobbyists as Democrats threaten investigations if they win Congress. Firms like World Liberty Financial and prediction markets Polymarket and Kalshi are bracing for scrutiny over potential conflicts of interest and favorable treatment.

Trump-Linked Crypto Firms Brace for Democratic Scrutiny

Companies tied to President Donald Trump and his family are quietly assembling legal and lobbying teams as Democrats threaten sweeping investigations should they win control of either chamber of Congress in the midterm elections. The firms span crypto projects, venture capital, and prediction markets, and include World Liberty Financial, 1789 Capital, Vulcan Elements, Polymarket, Kalshi, and figures such as Binance founder Changpeng Zhao, who received a presidential pardon.

Preparing for the Storm

Boards are already assessing risk and drafting responses to potential congressional inquiries. Law firms and lobbying shops with Democratic ties are being retained. Sean Clerget, a senior partner at Cozen O’Connor who advises on congressional investigations, said companies are evaluating exposure and refining their public messaging. Democrats have already sent document requests to World Liberty Financial and 1789 Capital, and have asked the Justice Department about the details of Zhao’s pardon.

Political and Legal Hurdles

Democrats aim to probe whether Trump’s inner circle received favorable government contracts or policy treatment. However, investigations face significant obstacles: some documents are overseas, such as the $500 million investment in World Liberty Financial by a vehicle linked to Abu Dhabi’s Sheikh Tahnoon bin Zayed Al Nahyan. Congress has limited power to compel foreign nationals to testify or produce documents. Moreover, past probes—such as Senator Ron Wyden’s inquiry into Jared Kushner’s Affinity Partners—have not led to criminal or civil charges. Legal experts suggest the Justice Department under Trump is unlikely to prosecute his business allies.

Industry Implications

The crypto industry’s entanglement with political power is deepening. World Liberty Financial generated $594 million in revenue for Trump last year, and its stablecoin USD1 has gained prominence with backing from Middle Eastern capital and Binance. Prediction markets Polymarket and Kalshi, both tied to the Trump family, are fighting state regulators over legality. The TRUMP meme coin has brought in $636 million. These financial ties are now under the microscope, and the outcome of the midterms could determine the intensity of oversight.

Forward Look

Even if Democrats win, they may struggle to advance investigations amid legal and political resistance. Noelle Acheson, author of the Crypto is Macro Now blog, noted that a Democratic majority would not eliminate the factors currently shielding the Justice Department, Treasury, and SEC from launching probes. Still, the mere threat of investigations is prompting firms to bolster compliance and lobbying, signaling that crypto’s political risk is rising. The sector must prepare for a more adversarial environment, balancing innovation with regulatory scrutiny.
