Financial institutions weighing a move on-chain have long assumed they must build or join permissioned networks to satisfy compliance obligations. A new thesis from a16z Crypto pushes back on that assumption, arguing that regulatory requirements can be enforced at the application layer rather than the settlement layer — allowing banks, brokers, and asset managers to operate on open, permissionless public blockchains without abandoning their legal duties.
The Compliance Layer Moves Up the Stack
The core argument is architectural. Permissioned chains were designed on the premise that compliance controls — identity verification, transfer restrictions, sanctions screening — must be baked into the network itself. But as public chains have matured, tooling for identity attestation, allow-listing, and transaction monitoring has migrated to smart contracts and middleware. That means a tokenized fund or a regulated stablecoin can carry its own compliance rules while still settling on a neutral, credibly neutral base layer.
The distinction matters commercially. Permissioned networks fragment liquidity, limit composability, and lock institutions into a single vendor’s roadmap. Public chains offer deep liquidity, battle-tested security budgets, and interoperability with the broader DeFi ecosystem. If compliance can be handled above the chain, the trade-off between regulatory safety and network effects largely disappears.
Why This Reframes the RWA Debate
The real-world asset sector has quietly become one of the most consequential corners of crypto. Tokenized treasuries, money market funds, and private credit products have drawn billions in inflows, with major asset managers now running live vehicles. Most of that activity has clustered on a handful of chains, and the question of which settlement environment wins has become a strategic battleground.

The Path Forward
None of this is a settled outcome. Regulators in the US, EU, and Asia are still writing the rules that will determine how much of a tokenized asset’s lifecycle can live on-chain, and supervisory expectations around custody, disclosure, and settlement finality remain unsettled. Institutions will also need to convince examiners that application-layer controls are as robust as the network-level guarantees they are used to.
Still, the direction of travel is clear. The debate is shifting from whether regulated finance belongs on public blockchains to how the compliance stack should be assembled around them. If the application-layer model holds up under scrutiny, it could unlock a far larger pool of institutional capital than permissioned silos ever could — and reshape which chains become the backbone of tokenized markets.
